New York, January 22, 2007 – A federal court in Pennsylvania has granted the firm's motion to dismiss on behalf of clients SGL Carbon, LLC and SGL Carbon AG in a case alleging price fixing in the graphite electrodes market. The plaintiff, Saudi Iron & Steel Co., accused SGL Carbon of participating in a worldwide conspiracy to fix the price of graphite electrodes, a product used in manufacturing steel. Shearman & Sterling moved to dismiss the complaint for lack of subject matter jurisdiction and argued that the plaintiff could not demonstrate its alleged injuries in the United States marketplace. Agreeing with the firm's position, Judge Norma Shapiro of the US District Court for the Eastern District of Pennsylvania dismissed the complaint in its entirety and denied the plaintiff the opportunity to replead. The firm has previously represented SGL Carbon in settling class action claims alleging a similar conspiracy.
