Lamson Quoted on 'Living Will' Resolution in The Deal
18 Apr 2011
Donald N. Lamson

Shearman & Sterling counsel Donald N. Lamson (Washington, DC-Financial Institutions Advisory & Financial Regulatory) was quoted in an April 11 article in The Deal (thedeal.com) on new details about the "living will" resolution process that certain financial institutions must engage in as a result of the Dodd-Frank Act. According to the article, rules following from the recent financial regulatory overhaul require applicable financial institutions to provide a clear dissolution plan to regulators but leave many aspects of the process murky. Said Lamson, who has extensive regulatory experience, "There are still unanswered questions. If the Federal Reserve and FDIC go back and tell a company to resubmit a plan, at what point does it become material and does it need to be disclosed?"
