Practice Christopher Ryan is a partner in the International Arbitration Group at Shearman & Sterling. He has extensive experience in international arbitration and litigation, and has represented private and governmental clients before international arbitral institutions, NAFTA Chapter 19 dispute resolution panels, the WTO Dispute Settlement Body, and U.S. federal courts. Mr. Ryan also has advised U.S. and foreign companies on various issues of public and private international law, investment and trade policy, and strategies for mitigating the risks associated with foreign investment. Mr. Ryan is a Lecturer at the University of Virginia School of Law, where he teaches a course on international investment law and investor-State disputes. Mr. Ryan also teaches a course on international commercial arbitration at the George Washington University Law School. In 2005, Mr. Ryan was a Visiting Scholar at Yale Law School, researching and lecturing on the area of international investment law.
Experience
- A European chemical company as Claimant in ICC arbitration and as a defendant in parallel U.S. litigation initiated by a European company. The case arises out of claims that Respondent misappropriated certain industrial trade secrets in the development of a chemical facility in Asia. Claimant seeks injunctive relief and unspecified damages.
- A U.S. industrial company in an ICC arbitration in London against a Middle Eastern State enterprise, arising out of a wide-ranging joint venture agreement. English law governs, and over US$4.5 billion is in dispute.
- Alcolac Inc. as a defendant in a putative class action lawsuit brought by Kurdish nationals in the U.S. District Court for the District of Maryland pursuant to the Alien Tort Statute and the Torture Victims Protection Act. Plaintiffs allege that Alcolac aided-and-abetted Iraq’s violation of U.S. and international law through Iraq’s use of chemical weapons against Kurdish civilians in 1988. Alcolac successfully moved to dismiss the case.
- An African government in a commercial dispute with a contractor over performance of a FIDIC Yellow Book contract.
- A multinational consortium of construction contractors in disputes concerning one of the world’s highest profile construction projects.
- A Central Asian State-owned entity as Respondent in an UNCITRAL arbitration initiated by a North American company. The case arises out of allegations of breaches by the Respondent of the applicable investment statute and contracts in relation to mining rights allegedly granted to the Claimant.
- A European chemical company as Respondent in an ad hoc arbitration and as a defendant in parallel U.S. litigation brought by a European company. The case arises out of allegations that Respondent used misappropriated trade secrets to secure certain patents.
- An English company as Clamant in an ICC arbitration and as defendant in parallel U.S. litigation against a German company. The case arose out of allegations that Claimant breached certain contractual obligations relating to the construction and operation of an industrial gasses facility in Asia.
- A Latin American construction company as Respondent in multiple ICC arbitrations brought by a U.S. company. The cases arose from allegations that Respondent breached various obligations under an EPC contract relating to the construction of an oil refinery.
- A U.S. financial institution as Claimant in ad hoc arbitration against private and government political risk insurance companies. The cases related to the denial of claims filed by Claimant arising out of the expropriation of certain insured investments in Latin America.
- Bank of America in the first successful “lenders” claim brought to the Overseas Private Investment Corporation. The claim involved the expropriation of insured assets in India.
- Various clients in trade-related matters before the U.S. Department of Commerce, U.S. International Trade Commission, U.S. Court of International Trade, U.S. Court of Appeals for the Federal Circuit, and NAFTA Chapter 19 panels.
