Practice

Ms. Kafele is a partner in the Litigation and Antitrust Groups in our Washington, D.C. office. She has extensive experience in complex litigation, investigations, and regulatory proceedings with a particular emphasis on complex antitrust issues. She has represented plaintiffs and defendants in monopolization, price-fixing, predatory pricing, bundling, tying, unfair competition and leveraging cases in state and federal courts across the country. Ms. Kafele also has represented a broad range of domestic and foreign clients with antitrust issues in state and federal investigations.


Recent Experience

Antitrust
  • Representation of a major European cargo airline in a federal multi-district class action alleging a conspiracy to fix the prices of air cargo
  • Representation of Syngenta in a lawsuit filed against Monsanto Company alleging Monsanto’s bundled discounts, sham patent litigation, and customer threats violated Section 2 of the Sherman Act
  • Representation of Watson Pharmaceuticals in an antitrust class action lawsuit alleging an agreement between Watson and a branded drug company to sell an “authorized generic drug” constituted unlawful monopolization, price discrimination and predatory pricing in violation of California antitrust laws
  • Representation of Watson Pharmaceuticals in a lawsuit filed against Bristol-Myers Squibb (BMS) alleging that BMS violated Section 2 of the Sherman Act by filing false patent information in the FDA Orange Book and filing baseless patent litigation
  • Representation of Watson Pharmaceuticals in an antitrust class action lawsuit alleging that a patent settlement agreement between Watson and a branded drug company violated the antitrust laws
  • Representation of INO Therapeutics in an antitrust lawsuit alleging unlawful tying and filing of a baseless patent lawsuit in violation of Section 2 of the Sherman Act
  • Representation of aaiPharma in three antitrust cases alleging conspiracy to monopolize and monopolization of the omeprazole drug market

  • Representation of General Electric in nationwide class action alleging various products liability claims relating to military radar
  • Representation of UFJ Bank in purchase price adjustment dispute
  • Representation of Guantanamo detainees in Rasul v. Bush decided in June 2004 in which the Supreme Court ruled that the detainees have the right to habeas corpus
