Practice Richard Schwed is a partner in the firm’s Litigation Group, with experience in a broad range of investigations and litigations, including antitrust, complex commercial disputes, arbitration, securities and banking. He represents clients before federal and state trial and appellate courts, arbitral panels and governmental and regulatory authorities. Mr. Schwed has conducted numerous jury and non-jury trials, and has considerable pre-trial and appellate experience. He also served as a law clerk to the Hon. J. Edward Lumbard, Jr., Second Circuit Court of Appeals, from 1993 to 1994.

Antitrust Experience Includes Representations of:
- Syngenta in a lawsuit against Monsanto alleging monopolization of markets for genetically modified corn seed
- Covidien in a class action jury trial alleging improper monopolization of a medical devices market
- BASF SE in a criminal investigation and in hundreds of class action, Attorney General and private lawsuits alleging price fixing of the vitamins markets
- Credit Suisse in class action lawsuits alleging price fixing of the “spreads” for initial public offerings
- Financial services companies in investigations into improper bid rigging in the insurance industry
- BASF in state and federal class action lawsuits alleging pricing fixing in the magnetic audiotape markets
- Manufacturing companies in confidential grand jury investigations into alleged price fixing arrangements

- Numerous financial services clients in internal investigations and investigations by the DOJ, the SEC, the CFTC, FINRA and state Attorneys General
- Hedge funds and banks in litigation arising out of the Lehman bankruptcy
- Credit Suisse in lawsuits alleging breach of contract, negligence, breach of fiduciary duty, fraudulent conveyances and conspiracy in connection with an underwriting
- Morgan Stanley in a class action securities litigation arising out of the Global Crossing bankruptcy
- Credit Suisse in a breach of contract lawsuit
- Morgan Stanley in class action litigations alleging breach of contract, negligence and fraud in connection with merger advice provided to an industrial services company

- Investors in Madoff-related litigation
- Continental AG in an arbitration involving a $60 million dispute regarding a merger
- Sun Pharmaceuticals in multiple lawsuits relating to its acquisition of Taro Pharmaceuticals and its ownership of Caraco Pharmaceuticals
- Pathmark in class action lawsuits arising from two potential transactions
- Rhodia in a lawsuit involving allegations of misrepresentation and breach of contract arising out of an acquisition
- Nielsen Media Research in an arbitration arising out of a dispute concerning the allocation of liabilities in connection with a spin transaction
- Snapple in litigation involving the Mayor and Comptroller of the City of New York
- A multinational consulting firm in a jury trial involving allegations of negligence and fraud arising out of an agreement to provide consulting services
