The German Federal Supreme Court (Bundesgerichtshof, BGH) specifies diligence requirements for management and supervisory boards relying on external legal advice

The German case law relating to the global finance and debt-crisis has experienced a tightening in the diligence requirements for members of the management and supervisory boards of corporations. By a judgment rendered on September 20, 2011, the BGH has now specified the requirements under which members of the management and supervisory boards can rely on external legal advice.
