Shearman & Sterling hosts Paris Arbitration Week Event on Approaches to Witness Evidence in International Arbitration

Senior associate Margaret Clare Ryan (London-International Arbitration) recently moderated the panel “Approaches to Witness Evidence in International Arbitration” hosted at our Paris office as part of this year’s Paris Arbitration Week. The event was organized by Young Canadian Arbitration Practitioners (YCAP) and held in conjunction with ICDR Y&I and CFA-40.

The panel examined different approaches to witness evidence in international arbitration in light of the recent “Inquisitorial Rules on the Taking of Evidence in International Arbitration” (the “Prague Rules”). It assessed the provisions on witness evidence under the Prague Rules, comparing them to those under the widely used IBA Rules of Evidence in International Arbitration.  It then explored approaches to witness evidence across a variety of civil law and common law jurisdictions and analyzed whether these different approaches are reflected in the current practice of international arbitration.
