Shearman & Sterling Achieves Pro Bono Victory for Former Restaurant Workers

Shearman & Sterling achieved a pro bono litigation victory for the former employees of the Kum Gang San Korean restaurant, which has branches in Manhattan and Queens.  Magistrate Judge Michael H. Dolinger of the United States District Court for the Southern District of New York granted total damages of $2,672,657.30 for all plaintiffs, which included unpaid New York Labor Law wages and Fair Labor Standards Act wages, diverted credit card tips and other tip amounts, as well as related liquidated damages.

Shearman & Sterling worked with the Asian American Legal Defense Fund and LatinoJustice (Puerto Rican Legal Defense and Education Fund) to represent eleven individual plaintiffs in their claims against their former employer for minimum wage violations, failure to pay overtime wages, diversion of tips collected and other related claims.
