Counsel Harald Halbhuber (New York-Capital Markets) wrote an article titled Debt Restructurings and the Trust Indenture Act that was published on June 14 in the Harvard Law School Forum on Corporate Governance and Financial Regulation.

The article is based on a recent discussion paper by Harald Halbhuber that uses thorough historical analysis to shed new light on the application of the Trust Indenture Act (TIA) to debt restructurings following the recent Marblegate district court decision. The paper ultimately concludes that debt restructurings that do not change payment terms do not implicate the TIA.
