COUNSEL SAM WHITAKER CO-AUTHORS ARTICLE ON TUPE AND EMPLOYEE SHARE SCHEMES

Counsel Sam Whitaker recently co-authored an article in the ELA Briefing (Vol. 27, No.4), entitled “TUPE and employee share schemes.”

The article explores the effect of TUPE on existing share awards, discusses whether TUPE requires the transferee to replicate the transferor's share scheme and examines the scope of the transferee's duty towards employees with contractual rights.
