Regulatory Risks of Doing Business in China

Shearman & Sterling partner Brian Burke (New York/Shanghai-Litigation) and Control Risks’ senior partner co-hosted breakfast briefings in Shanghai and Beijing on April 6 and May 16, respectively.
 
The partners discussed the regulatory landscape in China and addressed potential cross-border regulatory risks in the following areas, including:

  • The increasing regulatory enforcement from Chinese authorities, ranging from anti-corruption and anti-trust to tax and environmental protection
  • Regional geopolitical issues causing concern over the potential impact on operations in China.
  • Continued enforcement of the FCPA and the UK Bribery Act, along with uncertainties around the Trump administration’s moves on U.S.-China trade and potential reactions by Chinese authorities
