Partner Jessica Delbaum (New York-Antitrust) was recently featured in a Q&A with Global Competition Review. In this Q&A, Delbaum shares her insights on interesting antitrust trends and developments, both domestically and internationally. With respect to international issues, Delbaum notes, “The EU’s new Directive on Antitrust Damages is noteworthy in seeming to facilitate [follow-on damages] litigation, bringing with it additional considerations for companies both as potential plaintiffs and defendants.” Delbaum also discusses the antitrust litigation cases she is closely following, including the DoJ’s current trial against American Express challenging some of the company’s “anti-steering” rules. When asked to give one piece of advice to the DoJ or FTC, she points to the need for meaningful reform in the second request process. “[T]he costs and burdens of complying with a second request are disproportionately high compared to the benefits to the agencies of conducting an investigation,” she says.
