Experience
International arbitrations on which Ashish Mitter has worked include the representation of:
- Two subsidiaries of a North American mining and metals company in seven LCIA arbitrations in London against a European trading firm. The dispute relates to the performance of various contracts for the sale and purchase of metal concentrates. English law applies.
- Georgia, Respondent in an SCC arbitration initiated by Mr. Zaza Okuashvili under the Georgia-U.K. bilateral investment treaty. The dispute relates to taxes owed to the State by various companies owned by the Claimant. Before filing the arbitration, Mr. Okuashvili initiated emergency arbitration proceedings before the SCC, seeking to refrain the State from attaching assets owned by him and his companies in order to collect on the tax debt. We also represented Georgia in these proceedings.
- A private equity fund and its founder in ICC and HKIAC arbitrations initiated by the fund’s general partner and an alleged investor in the fund, as well as in related domestic court proceedings in multiple jurisdictions. The arbitrations each concerned ownership of various entities in the fund structure. Hong Kong and Cayman Islands law applied.
