Thirty years ago Berthold Goldman published his now famous article on the lex mercatoria in the Archives de philosophie du droit. It is no surprise that the topic continues to generate much interest. The controversy over the use of transnational rules by arbitrators is much more than doctrinal; it distinguishes fundamentally different notions of international commercial arbitration. Thus, we must embrace a highly nuanced approach to examining 1) the very use of transnational rules by arbitrators, and 2) their determination of the substance of those rules.
