The dispute settlement clause of an international contract is endowed with an important patrimonial value: it can seriously jeopardize the economic balance of the contract. Thus, certain interests must be kept in mind when drafting these clauses: the need for judicial neutrality, the greater importance of the law of the seat relative to the contract’s applicable law, and the need for simplicity of arbitral clauses.
