In Tahoe-Sierra Preservation Council v. Tahoe Regional Planning Agency, 122 S. Ct. 1465 (April 23, 2002), the United States Supreme Court ruled that temporary moratoriums on construction are not categorical takings that automatically require "just compensation" under the Fifth Amendment to the United States Constitution.
