A systematic analysis of the Cour de cassation’s case law relating to international arbitration over the past twelve years shows that the Court has consistently promoted the effectiveness of the arbitral process, both as regards the arbitration agreement and the enforcement of the arbitral award. Whilst in certain areas such as the control of international public policy and the enforcement of arbitral awards against reluctant States work remains to be done, the court’s strong and coherent case law powerfully resonates as the voice of one of the most modern arbitration laws.
