Overview
Michael Mitchell is a partner in the Litigation practice. He has significant and wide-ranging experience in complex civil litigation in federal and state courts and in governmental and regulatory investigations, having represented global financial institutions, companies, directors and officers, and individuals. His civil litigation practice is primarily focused on securities and antitrust class actions, complex commercial disputes, and shareholder and derivative suits. His substantial investigations experience includes representations of broker-dealers and other financial institutions and individuals in criminal and civil investigations by the DOJ and New York Attorney General, numerous investigations and enforcement matters by the SEC, CFTC, and FINRA, and investigations and inquiries by other SROs, including the NFA, CME, and various exchanges.

- Major financial institution in antitrust class action and direct actions relating to the U.S. stock lending market.
- Global financial institution in antitrust class action relating to U.S. Treasuries auctions.
- Japanese electronics company in antitrust class action and numerous direct actions relating to capacitors.
- Citigroup and affiliates in a number of suits and appeals in U.S. federal courts arising from collapse of Mexican oil-services firm Oceanografía S.A. de C.V.
- The special committee of the board of directors of Straight Path Communications, Inc. in connection with the company’s sale to Verizon Communications and a subsequent shareholder class action.
- Global financial institution and its broker-dealer affiliates in connection with investigations by the SEC and FINRA into a number of the firm’s alternative trading systems and trading strategies.
- Numerous underwriter syndicates with members including, variously, Barclays, Citigroup, Credit Suisse, Goldman Sachs, Morgan Stanley, and other global banks, in securities class actions on behalf of investors in companies such as Alibaba, Adeptus, SunEdison and others.
- Numerous global financial institutions, broker-dealers, and asset managers in connection with regulatory inquiries and investigations by the State Department, the DOJ, the SEC, and FINRA.
- Pro bono representation of Texas political parties, candidates, and voters in federal suit challenging the constitutionality of Texas’s ballot access laws.
