Litigation partner Daniel Laguardia and Litigation associate Mallory Tosch published an article in The Hedge Fund Law Report entitled "Navigating the Insider Trading Risks in Distressed Debt Trading."

The article discusses the insider trading risks presented by distressed debt trading in light of the increased trend of civil and enforcement actions asserting insider trading violations. The article specifically examines four recent cases that exemplify the sometimes-aggressive positions taken by regulatory agencies and private litigants where potential claims for insider trading are at issue. Laguardia and Tosch also discuss ways in which companies engaged in distressed debt trading can protect themselves against allegations of insider trading.
